Establishment of an administrative tribunal for traffic violations under the authority of the Justice Minister and the Ministry of Justice. The President and the judges of the Tribunal will be appointed by the Minister and a committee comprised of the Director General of the Ministry of Justice, an emeritus judge to be appointed by the Minister, and a representative of the public.  The Tribunal will have national jurisdiction.  (The Bill was initiated by the previous Government.)

Damages may be claimed from a labor organization that goes on strike for purposes other than protecting employee rights. Restricting the basic right to strike in an attempt to suppress opposition to the judicial overhaul legislation.

Any identification with an act of terror, any praise of a terrorist, any display of sympathy for terrorism and any hoisting of the flag of a terrorist organization will constitute a criminal offense pursuant to the War on Terror Law, with  the penalty prescribed in the Law. Broadens existing restrictions in the law in a way that enables drastic and politicized repression of free speech.

Transfers control of Bar Association membership fees from the Bar itself, independent since its formation in the 1950s, to the Minister of Justice. Part of Government effort to take control of the Bar Association’s two key seats on the Judicial Selection Committee; filed after the Bar Association did not elect the Government’s candidate for head of the Bar.

Establishment of a Senior Appointments Committee at the Knesset instead of the current non-political Appointments Advisory Committee, that will decide on appointment of the IDF Chief of Staff, the Police Commissioner, the Head of the General Security Services, the Head of the Mossad, the Chief Warden of the Prisons Service and the Governor of the Bank of Israel.

Makes decisions by the main regulator of the broadcast media regarding broadcast licenses subject to the Knesset Economics Committee – and thus controlled by the ruling Government coalition.

Eliminating the existing Authority for the Advancement of the Status of Women and establishing in its place a new Authority for the Advancement of Women in Israel, in which the Director is appointed by the Government directly without the usual tender process.

In addition to the current declaration by incoming heads of mission, that “I undertake to maintain loyalty to the State of Israel and its laws and to honestly and loyally perform any obligation imposed upon me as an employee of the State”, they will also declare: “I undertake to maintain loyalty to the State of Israel as a Jewish and democratic state”.

Members of any internal institutions of political parties such as a party central committee, party delegates, conference members, etc., shall be entitled to be elected as directors of government companies. Previously restricted to professional appointments vetted by an independent committee; a open license for patronage jobs.

Strikes in the education system will be conditional upon conducting arbitration proceedings with respect to labor disputes.

Extending the cooling-off period for the Attorney General and the State Prosecutor before appointment to the Supreme Court, from 1.5 years to 5 years. Longer than statutory cooling-off periods for other senior officials; seen as aiming to control composition of Supreme Court.

Guaranteeing  ultra-Orthodox representation as employees of government companies, in all functions and ranks, including ‘adaptation’ of tenders, designating jobs solely for the ultra-Orthodox, in proportion with their percentage of the general population, and during the first five years from passage of the Law, at double their percentage in the population.  Same policy for municipalities and local councils.

Appointment of the Examination Committee that is responsible for preparing the Bar examinations will not be subject to the duty to consult with representatives of the Israel Bar Association.

Establishing a day to commemorate the activity of Rabbi Menachem Mendel Schneerson, also known as the Lubavitcher Rebbe.

No standing for NGOs funded by foreign official entities to file petitions in the Israeli Supreme Court unless they can show they are directly harmed by the decision being challenged.

Changing the Knesset voting procedure for appointing the State Comptroller, religious judges and Knesset representatives on the Judicial Selection Committee, from secret ballot to open ballots by name, in order to ensure the enforcement of party and coalition discipline.

The Government would no longer be bound by the legal opinions of the Attorney General or the Legal Advisors of the various Ministries, but can decide itself what legal position will be presented on its behalf before a court. The Government, or any Minister will have the power to decide whether the AG and his representatives will represent the Ministry in legal proceedings, or an external legal counsel.  Currently, if the AG deems the Ministry’s position illegal or indefensible in Court, the Ministry can seek outside legal representation with the AGs consent, which is typically granted.  A major change to the rule of law, in which different Ministries can take different positions on the same legal issue.

Revocation of the recognition of a students organization as ‘representative students’ organization’ against the backdrop of the calls by the Students Union “to fight the State Budget in general and the budgeting of Torah institutes in particular”.

Cancelled the Court’s use of a long-established rule that enabled it to review and invalidation of administrative decisions that were deemed “extremely unreasonable”, for decisions by the Government or any Minister

The term of office of a justice of the Supreme Court, following the date of his appointment, shall be not less than 7 years and not more than 12 years, after which he may not be reappointed as a justice of the Supreme Court. (Currently all judicial appointments are until mandatory retirement at 70.)

Cancels  the Court’s ability to review administrative decisions by Ministers or the Government using the long-standing “reasonableness” standard, and to invalidate decisions that are found to be “extremely unreasonable”.

Three years’ imprisonment for any person who publishes, orally or in writing, statements comparing events, elected representatives, government symbols or organizations to the Nazi regime or to the actions that were taken during the period of the Nazi regime, and which are crimes against the Jewish People or crimes against humanity.

Gives the ruling Coalition a veto over  candidates for appointment as Supreme Court justices – the Knesset Constitution Committee will decide whether to approve the candidacy of a nominee for appointment as a Justice of the Supreme Court after conducting a public hearing of the candidate before the members of the Committee.

The Supreme Court will not be able to invalidate Knesset legislation unless it is incompatible with a Basic Law, and only by  a panel of 13 justices (out of 15).

The Central Elections Committee, currently chaired by a sitting Supreme Court Justice, will be controlled by the ruling Coalition, and its decisions about disqualification of a Knesset list, or of individual candidates, from running for election will no longer be subject to Supreme Court review.

A person committing an offense in the Temple Mount precinct shall be liable to double the penalty prescribed for such offense.

One year’s imprisonment for participants in a gathering of at least three persons at which the Palestinian flag is hoisted. This law directly undermines freedom of speech and assembly.

This bill lengthens the cooling off period for appointment to the Supreme Court of the Attorney General, Deputy Attorney General,  State Attorney, the Deputy State Attorney and Knesset Attorney General from 1.5 to 5 years. This law aims to marginalize current legal advisors and law enforcement, perceived as hostile to the present Coalition in general and to PM Netanyahu in particular.

A law may be enacted which harms the rights of illegal migrants notwithstanding the Basic Law: Human Dignity and Liberty, if the law explicitly says so.

One of many proposals seeking to undo the possibility of judicial review, by this law, the High Court of Justice will only hear petitions in a full panel of 15, may invalidate laws only for technical procedural reasons and not for their substance; moreover, the Knesset may override the disqualification of a law by a simple majority of 61 for a period of 5 years, and if reenacted, the law is immune to judicial review.

Immunity from criminal liability for the security forces, the IDF, police officers, the Knesset Guard and a Civil Guard actively involved in operational incidents.

The Chairman of the Central Elections Committee will be appointed at the recommendation of the Knesset Speaker by the Plenum of the Central Elections Committee, and in any event, shall not be an acting or emeritus Justice of the Supreme Court, as is the case today. This law aims to ensure Coalition control of elections.

Mandatory public hearings of the Judicial Selection Committee.

Three years’ imprisonment and a minimum fine of NIS 5,000 for persons who hoist the flag of the Palestinian Authority and one year’s imprisonment to any person who participates in a gathering of at least 3 participants where that flag is raised.

This law strikes at both freedom of speech and of assembly.

Increases the number of justices of the Supreme Court from 15 to 18. This will automatically give the current Government three new appointments. Taken with other proposals for unanimity of the full court in judicial review it will make it nearly impossible for the Court ever to invalidate any act of Parliament.

In Israel, unlike in the US, the Attorney General also serves as Legal Advisor and Counsel to the governing coalition. This bill will split those two functions, and is connected to PM Netanyahu’s attempt to end his ongoing criminal trial by moving authority over criminal cases from the current Attorney General to a newly created Prosecutor General.

Alteration of the composition of the Judicial Selection Committee: The two judges on this version of the Committee will not be from the Supreme Court, but rather from the District Court and the Magistrate’s Court.

Until now the Ombudsman for the Judiciary was  an emeritus judge appointed jointly by the Chief Justice and Justice Minister. This law changes that and says the Commissioner must be “a person who was qualified but not appointed” as a judge The stated reason is to assure the Commissioner’s independence and is aimed at the Current Commissioner, a former Supreme Court Justice.

Up to now, removing a minister or deputy minister from office on suspicion of criminal activity has been a decision for the Supreme Court. This law puts that decision in the hands of the Knesset itself. s

Institutions that cooperate with entities that support a boycott of Israel will not be entitled to state-sponsored prizes. This is aimed to curtail political dissent.

Denial of social security benefits for up to 18 years for loosely-defined offense of harm to the dignity of the State flag and symbols.

Public hearing proceedings for Supreme Court candidates and secret ballot for Supreme Court Justices on the Judicial Selection Committee.

Until now the President of the Supreme Court is chosen on the basis of seniority. This bill replaces seniority with a Knesset vote and bars a potential Chief Justice due to retire within 3 years, so as to ensure long-term control of the Court by the Knesset.

No state-funded educational institution will permit the hoisting of the flag of a hostile state, the Palestinian Authority (with which Israel has signed agreements and with whom it regularly coordinates on security) or a terrorist entity on its premises.  A student will be suspended for 6 months, and on repeat offense, be permanently expelled and barred from obtaining a degree from any educational institution whatsoever. A staff member will be suspended for 6 months, and on repeat offense be permanently expelled.  An institution that does not comply with the rules will have 10% of the budget taken from it.

The law also enacts mandatory one year’s imprisonment for a person hoisting the flag of a hostile country, terrorist organization of other hostile entity acting against Israel, including the flag of the Palestinian Authority in general, including in demonstrations.

Currently, regular judicial appointments require a simple majority of the appointments committee and appointments to the Supreme Court require a super majority. This law repeals the super majority  requirement, further ensuring government control over the Court.

This bill, part of the Coalition’s assertion of total control over judicial appointments, replaces the current two representatives of the Israel Bar Association, with two picked by the government.

This seemingly innocuous law, imposing a 5 year term limit on the legal advisors to municipal authorities, is meant to remove current legal advisors who have imposed limits on local officials, Ultraorthodox officials in particular.

Until now, the Attorney General has been able to request revoking a Knesset member’s parliamentary immunity. This law dissolves that authority and puts it at the sole discretion of the Knesset itself.

This bill undoes the Police force chain of command and allows to Minister directly to intervene in investigations and commanders’ policy judgements.

Legal immunity from criminal liability for  the security forces during operational activity.

Revocation of the right to medical treatment to persons convicted of terrorism and their first degree relatives.

This bill repeals the Kashrut reforms enacted by the previous government, which loosened Chief Rabbinate control and facilitated independent, local, and sometimes non-profit, Kashrut certification agencies.

The agreement that formed the Gantz-Netanyahu Unity Government in May 2020, at the height of COVID, included a rotation agreement, and said that the government would dissolve if a budget was not passed. Netanyahu made passage of the budget in order to keep himself in power, and at great cost to Israel’s public policy and economy. This law is meant to enable Netanyahu to rule in the future without hindrance of passing a budget, and to make it impossible to, disband the Knesset during the first year without a majority of 70.  A failure to pass the budget will not result in disbanding of the Knesset.

Allocation of beaches for gender-separated bathing or gender-separated bathing times at beaches

Individual Members of Knesset will have  standing to petition the Court on public matters, irrespective of the position of the Government and the relevant Ministries

This provision outlaws missionizing, in particular by Evangelical Christians.

The Government selects the Justices, appoints the Chief Justice and the Deputy Chief Justice even if they were not Justices of the Supreme Court beforehand; tenure limited to age of 70 or for 12 years.

Torah study to be on par with “significant service to the State of Israel and the Jewish people”.  This seemingly innocuous pronouncement aims to create a blanket exemption from military service for Ultraorthodox men, and to give them the same benefit entitlements as IDF veterans.

Politicization of Legal Advisers: Legal Advisors of government ministries to be appointed as fiduciaries

At least 15% of the hours of operation of bathing sites at the Nature and National Parks Authority sites will have gender separation.  Local communities, Jewish, Muslim and Christian, have different practices and concerns regarding public bathing. This law takes the matter out of local hands and creates a one-size fits all national policy.

Rabbis will not bear criminal liability and will be immune from legal action for publishing a Halakhic treatise and expressing an opinion on matters relating to the Torah. Recent years have seen extremist rabbis issuing legal rulings urging wide-scale violence against Arabs. This law seeks to fracture the delicate balance between free speech and incitement by granting rabbis immunity for any such pronouncement, while criminalizing similar pronouncements from the Left.

Recent years have seen a number of Orthodox youth choosing to lead non-Orthodox lives. This law defines discussing those choices as “corruption of morals,” and criminalizes disseminating materials calling on minors to leave religion.

Basic Law: Human Dignity and Liberty, enacted in 1992, is the cornerstone of Israeli jurisprudence as regards basic principles of human rights and securing Israel’s character as a Jewish and Democratic state. This bill will enable the Knesset simply to undo this law and transform the foundations of Israel’s politics and society.

Denial of public funding for any political party that calls for a boycott of Israel (including in the territories). This is meant to undercut Arab and Left parties.

Expansion of the jurisdiction of the Rabbinical courts beyond marriage and divorce into civil areas, which were not previously under their jurisdiction. This will tighten Rabbinical control over marriage and divorce even further by cutting off recourse to civil courts, and will especially effect women who are already structurally disadvantaged in the Rabbinic courts.

A place or product may only be represented as being Kosher if they have received the approval of the authorized entities. This bill seeks to ensure the lucrative monopoly of the Rabbinate on kosher certification, and undercut new Kosher certification agencies, some of which are non-profit.

Aggravation of penalties for stone throwing – setting of a minimum punishment. Stone-throwing can be fatal; at the same time, these offenses are regularly committed by minors and Arab stone-throwers are treated more harshly than Jewish stone-throwers.

Automatic death sentence for persons convicted of murder against the backdrop of terrorism (loosely defined).

In Israel, the Attorney General also acts as Solicitor General, representing the Government and Ministers in court. This law will enable Government and Ministers to bypass the Attorney General and represent themselves in Court when the AG disagrees with their positions, which has happened several times since the formation of the current Coalition.

Blanket immunity from criminal liability to the security forces (IDF, GSS etc) for activities done while in operational activity on duty.

Cancellation of the grandchild clause in the Law of Return. Having one Jewish grandparent will no longer suffice for automatic citizenship under the Law of Return. The grandparent criterion was enacted because under Nazi law, one Jewish grandparent was sufficient to be marked for persecution. This law will apply only the Halakhic standard of who is a Jew, making a large segment of identifying Jews abroad ineligible to become “Olim”.

Disqualification of a person or list who support a boycott of Israel from competing in elections.

Alteration of the composition of the Judicial Selection Committee (3 judges, 5 coalition members, 1 opposition member, 2 representatives of the public to be selected by the Minister of Justice), disqualification of laws by an 80% majority in a full panel, superiority of Basic Laws, override clause by 61 (pending next Knesset) and revocation of the cause of action of reasonableness.

This Bill, like others, seeks to give the governing Coalition total control over the judiciary. Here, first, by changing the composition of the Judicial Selection Committee and, second, by replacing the seniority system which up to now has determined who will be   Chief Justice and Deputy Chief Justice, allowing the Coalition directly to appoint Chief and Deputy Chief Justices who have never served on the Court. .

Almost all Israeli universities and many colleges are publicly funded. This bill slashes the budgets of academic institutions that cooperate with entities that deny the existence of the State of Israel as Jewish and democratic, that call for the trial of soldiers accused of war crimes, that support the struggle and boycott of Israel, and/or incite racism or violence.  All these offenses are very loosely defined and would cover not only active incitement but theoretical conversations too.

Academic expulsion and denying academic degrees to any student who expresses support for armed struggle against Israel, who participates in an act of terrorism or a terrorist organization, or who hoists the flag of a hostile state, terrorist organization or the Palestinian Authority.

This bill aims to curtail the work of civil society organizations in supported by foreign state entities, such as USAID or the European Union

This bill grants Israeli soldiers blanket immunity from criminal prosecution for their actions while in operational activity on duty.

The General Security Services, whose work until now has been limited to preventing terror attacks will be turned into domestic law enforcement, focused on Israel’s Arab citizens. This bill has been opposed by the GSS itself and its leaders past and present.

Bystanders and activists will be prohibited from filming Israeli soldiers on their cellphones.

Tightening of the right to be elected – a person convicted of terrorism will be barred forever from standing for election to the Knesset (at present, he may stand if 14 years or more have passed since the conviction).  This is aimed at Palestinian activists who choose to abandon terror after incarceration and work through the political system.

Installation of a nationwide camera system that will identify and track people in real time without a warrant.

Prohibits the introduction of leavened products into hospitals during the Passover. – until now policies on this sensitive question were left to the discretion of Hospital management, who are attuned to the needs and character of their local communities.

The “Gifts Law”: A public servant may finance legal and medical expenses for themselves and family through private donations, with no restrictions.

Deputy Directors General of Government Ministries – the Chief Operating Officers of the Ministries – are no longer to be independent civil servants but political appointees.

Supreme Court Justices and Chief Justice are to be directly chosen by the Governing Coalition with Parliamentary approval.

The High Court of Justice will only hear petitions by a full panel of 15 Judges, including thousands of ‘simple’ petitions with no public import – which adds a major procedural hurdle to any petition.

Alteration of the Judicial Selection Committee so that the Coalition will have an automatic majority and total control over all judicial appointments at all levels.  The Committee will comprise 11 members: 3 judges, of whom 1 shall be the Chief Justice of the Supreme Court, 3 Government Ministers of whom one shall be the Minister of Justice, 3 representatives of the Coalition and 2 representatives of the Opposition.  The Chief Justice of the Supreme Court and the first two appointments in any Knesset term shall be based on the Coalition’s majority on the Committee.

The “Incapacity Law”: The Prime Minister can only be declared ‘incapacitated’ on physical or mental grounds, and only if the PM himself asks to be so declared, or 90 of 120 MKs. No incapacity for any other reason such as criminal proceedings or violation of conflict of interest obligations.  No review of such decisions by the High Court of Justice.

Supreme Court can only rule a law unconstitutional by a majority of 80% of the full Court.

Supreme Court cannot rule a law unconstitutional except by unanimous decision of the full Court, and even then, the Knesset can override their decision with a simple majority of 61 members out of120

The High Court of Justice may not intervene in ministerial appointments, even when the potential appointee has been convicted of multiple felonies.

The National Library of Israel will no longer be an independent scholarly and educational institution but be directly controlled by the State.

The Police Internal Affairs Investigation Unit will no longer work with the State Attorney’s Office but will report directly to the Justice Minister, who will also appoint the head of the Unit.,  Politicization of the Investigations Unit.

Legal Advisors of Ministries will no longer be independent civil servants but political appointees.

Revocation of the Offense of Fraud and Breach of Trust (notably, PM Netanyahu is currently on trial for those offenses, among others)

– This law immunizes a sitting Prime Minister against any criminal investigation.

The Orthodox Chief Rabbinate will have sole discretion in determining what constitutes desecration of holy sites, such as whether or not groups of women may pray at the Western Wall.

Electoral threshold of 60% in elections to  local committees of  regional council. This bill will make it impossible for even sizable minorities to obtain representation in their communities.

In Israel, unlike in the US, the Attorney General also serves as Legal Advisor to the governing coalition. This bill will split those two functions and the Attorney General will be appointed by the Justice Minister and the relevant Knesset Committee. Likely connection with PM Netanyahu’s ongoing criminal trial.

If at least 3 people assemble and publicly unfurl the flag of an enemy state or any entity or body that is ‘not friendly’ to the State of Israel or doesn’t allow display of Israeli flag, that assembly will be illegal and subject to one year’s imprisonment.

Three years’ imprisonment for  blocking or damaging a public road with intent to impede  traffic or obstruct  movement of vehicles.  A response to protests in which streets were blocked.

The Accountant of the Ministry of National Security and the Accountant for the Israel Police Force will be the same person. Until now, the Police Accountant was  a professional appointment from among the ranks of the Police Force, by the Chief Commissioner of Police in consultation a with the Minister.

Security prisoners and detainees who have not yet stood trial may be visited only byfirst degree relatives, and no more than once a year.

Any NGO supported by a foreign state entity (such as USAID or members of the EU) must disclose that info when  petitioning to the Supreme Court on any matter, and the Ministry of Justice must transfer the petition to the Foreign Ministry.

This bill gives political appointees a blanket exemption from ever having to disclose recordings, photos, documents or communications exchanged the Prime Minister or any other Minister, related to the employee’s professional services, similar to the exemptions between lawyers and clients, or between spouses.

The duty to hoist the State flag even at educational institutions that are not formally recognized by the Education Ministry, such as some Haredi, Beduin and other schools

At every educational institution, the curriculum shall include lessons in history and Israeli heritage, including the Torah, the history of the Jewish people, and Jewish tradition, starting in first grade.
